FirstToFly CRM is a Customer Relationship Management application that provides the following features:

• Contact Management: Create, organize, and manage customer contacts and leads.
• Team Collaboration: Add team members and manage roles and permissions.
• Multi-Channel Communication: Connect and communicate through various channels including WhatsApp, Facebook Messenger, Instagram, Telegram, and Email.
• Automation: Create workflows and automate customer interactions.
• AI Agents: Configure AI-powered agents to assist with customer communications.
• Templates: Create and manage message templates for efficient communication.
• Analytics: Track and analyze customer interactions and team performance.

a. Registration

To use the Application, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

b. Account Security

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

c. Account Requirements

• You must be at least 16 years old to use the Application.
• You must provide a valid email address for account verification.
• Each user must have their own account; sharing accounts is prohibited.

You agree not to use the Application to:

• Violate any applicable laws, regulations, or third-party rights.
• Send spam, unsolicited messages, or engage in any form of harassment.
• Upload or transmit viruses, malware, or any malicious code.
• Attempt to gain unauthorized access to the Application or its systems.
• Impersonate any person or entity or misrepresent your affiliation.
• Use the Application for any illegal, fraudulent, or unauthorized purpose.
• Interfere with or disrupt the integrity or performance of the Application.
• Collect or harvest user data without proper consent.
• Violate the terms of service of any integrated third-party platforms (e.g., WhatsApp, Facebook, Instagram).

The Application integrates with third-party services including but not limited to:

• WhatsApp Business API and WhatsApp Web
• Facebook Messenger
• Instagram Direct
• Telegram
• Email providers (Gmail, Outlook, etc.)

Your use of these integrations is subject to the respective terms of service and privacy policies of each third-party service. We are not responsible for the practices or content of these third-party services. You are responsible for ensuring your use of these integrations complies with their terms.

a. Our Rights

The Application, including its design, features, code, documentation, and all related intellectual property, is owned by FirstToFly Pte Ltd. All rights not expressly granted in these Terms are reserved. You may not copy, modify, distribute, sell, or lease any part of the Application without our prior written consent.

b. Trademarks

"FirstToFly," "FirstToFly CRM," and related logos are trademarks of FirstToFly Pte Ltd. You may not use these trademarks without our prior written permission.

a. Ownership

You retain ownership of any content you upload, submit, or transmit through the Application ("User Content"), including contacts, messages, templates, and other data.

b. License to Us

By uploading User Content, you grant us a limited, non-exclusive, worldwide license to use, store, process, and display your User Content solely to provide and improve the Application.

c. Your Responsibilities

You are solely responsible for your User Content and ensuring it does not violate any laws or third-party rights. We do not endorse or guarantee the accuracy of any User Content.

If you subscribe to a paid plan, the following terms apply:

• Billing: You agree to pay all fees associated with your subscription plan. Fees are billed in advance on a monthly or annual basis.
• Payment Methods: We accept major credit cards and other payment methods as displayed in the Application.
• Refunds: Fees are non-refundable except as required by law or as explicitly stated in writing.
• Price Changes: We may change our pricing with reasonable notice. Continued use after price changes constitutes acceptance.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRSTTOFLY PTE LTD SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, revenue, data, or business opportunities.
• Any damages arising from your use of third-party integrations.
• Any damages exceeding the amount you paid us in the twelve (12) months preceding the claim.

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You agree to indemnify, defend, and hold harmless FirstToFly Pte Ltd, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Application.
• Your User Content.
• Your violation of these Terms.
• Your violation of any rights of a third party.

a. By You

You may terminate your account at any time by contacting us or using the account deletion feature in the Application settings.

b. By Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Application, other users, or third parties.

c. Effect of Termination

Upon termination, your right to use the Application will immediately cease. We may delete your account and User Content, though some information may be retained as required by law or for legitimate business purposes.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the Application or by sending you an email. Your continued use of the Application after the effective date of any changes constitutes your acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of Singapore.
